미국이민법에 따라 모든 이민비자 신청자는 미국에 영구히 거주할 것이라고 간주됩니다.
미국을 출국할 당시에는 미국으로 되돌아갈 의사가 있었으며, 전혀 그 의사를 포기하지 않았으나, 어쩔 수 없는 사정으로 인하여 미국 외의 지역에 12개월 이상 거주하게 된 분이 미국에 다시 거주하기 위해서는 새 이민비자를 받아야 합니다.
이민자로서의 자격이 소멸된 경우, 재입국자 의 자격에 해당될 수 있습니다. 그렇지 않으면 초청자가 이민초청장을 다시 제출해야 합니다.
