법적 별거
경우에 따라 부부는 종교, 보험, 세금등의 이유로 이혼보다는 법적 별거를 결정할 수도 있습니다. 법원으로부터 이혼판결문이 나오면 완전한 이혼이 끝나는 반면, 별거는 판결 후에도 양 부부의 합의에 따라 법적 부부로 남아있게 됩니다. 예를 들면 법적 별거 이후에 각각의 배우자가 벌어들이는 소득은 이혼시 적용되는 공동재산권에 적용되지 않고 마찬가지로 각 배우자가 지게 되는 빚은 각자의 책임으로 남게 되지만 건강보험등의 경우에는 양 배우자가 서로 합의에 의하여 서로가 상대방의 건강보험상의 혜택을 누릴 수 있습니다.
