자녀 양육비와 위자료
자녀양육비: 양쪽 부모는 이혼후에도 미성년자녀의 가장 적합하고 적절한 부양을 위해 각부모의 사정을 고려한 부모로서의 공동책임이 있습니다. 그러므로, 자녀양육비에 관한 결정은 양쪽 부모의 수입이나 각부모의 실질적 양육기간등을 고려하여 내려지게 됩니다. 일반적으로 자녀양육에 관한 책임은 자녀가 18세가 되거나 고등학교 졸업시 하지만 이경우에도 자녀가 19세가 되는 때에 면제되어지게 됩니다.
위자료: 법원은 배우자의 재정상태나 계획등을 고려하여 한시적인 위자료를 명령할 수 있습니다. 하지만 어느경우에도 영구적 위자료는 주어질 수 없습니다. 한시적인 위자료도 수혜자가 죽거나 다른사람과 결혼하게 되면 취소되어집니다. 일반적으로 한시적인 위자료는 결혼이 10년이상 지속되지 않았을 경우 총 결혼기간의 반 정도 기간동안 주어지게 되며 10년이상 결혼기간이 지속되었을 경우 위자료를 받는 배우자가 죽거나 다른 사람과 결혼하게 될때까지 주어지게 됩니다.
