자녀 양육권 및 방문권
자녀 양육권및 방문권에는 법적인 양육권과 실질적인 양육권의 두가지가 고려되게 됩니다.
법적인 양육권 (Legal Custody)은 자녀의 학교를 결정하거나, 자녀에 대한 의료시술문제에 대한 결정, 종교교육, 학교기록이나 의료진료기록등을 볼 수 있는 권리등을 포합합니다
실질적인 양육권 (Physical Custody)은 법원에 의해서 보통 한쪽 부모에게 주어지게 됩니다. 자녀는 실질적 양육권이 있는 부모와 거의 모든 시간을 보내게 되고 실질적 양육권을 갖지 않은 다른 부모는 대신 자녀를 방문할 수 있는 방문권을 가지게 됩니다.
