결혼 무효소송
결혼무효소송은 결혼당시 있었던 어떤 문제로 인하여 그 결혼은 적법하지 않았다는 주장에서 이뤄지게 됩니다. 그러므로 이혼소송과 달리 결혼무효소송은 결혼의 적법성에 문제가 있다고 생각되어 지는 경우에만 이뤄질 수 있습니다.
예를 들어 결혼시 법적으로 요구되어 지는 어떠한 의식/의례 자체에 문제가 있었다든지 (결혼증서, 결혼선서 또는 결혼인증서등) 아니면 법적으로 허용되지 않는 결혼이었던 경우에 결혼무효소송이 이뤄집니다. 예를 들자면 근친상간, 중혼, 사기 또는 강제로 결혼하는 경우, 또 한명의 배우자가 미성년자이었거나 법적 행위를 이해할 수없다고 간주되어지는 정신질환자이거나 법적 무능력자인경우가 있을 수 있습니다)
